1. Introduction

Welcome to itsgiving.fit, a sole proprietorship. By accessing or using our website, application, and AI-powered wardrobe and styling services (collectively, the “Services”), you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, you may not access the Services.

2. AI Styling & Wardrobe Services

Our Services utilize advanced artificial intelligence to digitize your wardrobe, generate outfit combinations, and provide personalized styling advice. You acknowledge that:

• AI-generated outfits and styling recommendations are for informational and entertainment purposes.
• The quality of AI generations depends on the clarity and quality of the garment images you upload.
• We do not guarantee that the AI will always produce perfect or culturally appropriate combinations, though we continuously strive to improve our models.

3. User Content & Images

By uploading images of your clothing, accessories, or yourself to itsgiving.fit, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process this content solely for the purpose of providing and improving the Services.

"User Content" means any images, photos, or other content you upload to the Services, including reference photos of your face used to generate your avatar ("Avatar Data").

By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to use, store, host, and process such User Content solely to: (a) provide and operate the digital wardrobe, AI styling, avatar, and virtual try-on features of the Services; and (b) where you have given separate, explicit opt-in consent as described in our Privacy Policy, improve our underlying AI/ML models.

Retention & Deletion: In keeping with the principle of data minimization, we retain User Content only for as long as your account remains active or until you delete the relevant item from your digital wardrobe, whichever is earlier. Deleted items are removed from our active storage within 30 days, subject to routine backup cycles.

Consent & Withdrawal: Providing User Content for the core wardrobe and styling features is necessary to use those features. Using your images or Avatar Data to improve our AI models is optional, requires your separate opt-in consent, and can be withdrawn at any time from your account settings or by contacting us, without affecting the lawfulness of processing carried out before withdrawal.

You represent and warrant that you own or have the necessary rights to any User Content you upload, and that it does not violate any third-party rights or applicable law.

4. Credits & Payments

Certain features, including AI outfit generation and high-resolution renders, require the use of credits. "Credits" means a limited, non-transferable virtual entitlement that permits access to specific features of the Services, such as AI outfit generation, avatar creation, or high-resolution renders. Credits have no monetary value outside the Services, cannot be exchanged or redeemed for cash, and do not constitute a financial instrument, security, or deposit.

• Credits can be purchased or granted as part of a subscription plan.
• Credits are non-transferable and, unless required by law, non-refundable.
• In the event of a system failure during an AI generation, credits are automatically refunded to your account ledger.

5. User Conduct

You agree not to use the Services for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You may not attempt to reverse engineer our AI models, scrape our data, or bypass our credit and subscription mechanisms.

6. Limitation of Liability

To the maximum extent permitted by law, itsgiving.fit shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Services. Our total aggregate liability arising out of or relating to these Terms shall not exceed the amount, if any, that you paid us in the three (3) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless itsgiving.fit and its owner/operator from and against any claims, losses, liabilities, and expenses arising out of your breach of these Terms or your misuse of the Services.

7. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by updating the date at the top of this page. Your continued use of the Services after any changes constitutes acceptance of the new Terms.
